📜 1. Agreement & Overview
These Terms of Service ("Terms") govern your access to and use of FieldSmith ("Service"), provided by Callsmith. By creating an account, enabling call forwarding (*72), installing the mobile application, or purchasing a subscription, you agree to be bound by these Terms.
If you are using FieldSmith on behalf of a contracting business, trade company, or corporate entity, you represent that you have the authority to bind that entity to these Terms.
📞 2. Telephony & Carrier Call Forwarding
FieldSmith operates in conjunction with standard carrier telephony features:
- Forwarding Activation (*72) & Deactivation (*73): You are responsible for dialing your cellular carrier's unconditional or conditional call forwarding codes (*72 or carrier equivalent) to route calls to your dedicated FieldSmith AI number. Dialing *73 returns call answering directly to your mobile handset.
- Carrier Charges: Standard airtime, forwarding, and messaging rates from your wireless carrier (Verizon, AT&T, T-Mobile, etc.) may apply to forwarded calls. FieldSmith is not responsible for wireless carrier billing fees.
- Number Ownership: FieldSmith provides an operational virtual routing number for AI screening. You do not acquire ownership or porting rights to temporary inbound gateway numbers unless explicitly provisioned under an enterprise 10DLC agreement.
🤖 3. Automated AI Screening & Answering Disclaimer
Automated Assistant Notice: FieldSmith uses advanced Artificial Intelligence (Google Gemini & synthetic voice synthesis) to answer, qualify, and categorize incoming calls. While engineered for high accuracy in residential and commercial contracting trades, automated systems may occasionally misinterpret verbal accents, background noise, or unclear statements.
Contractor retains sole professional discretion for reviewing lead dossiers, approving quotes, executing contracts, and performing on-site trade work. FieldSmith does not guarantee specific job close rates or revenue outcomes.
🚨 4. Emergency Dispatches & GPS Location Disclaimer
CRITICAL SAFETY NOTICE ? NOT A 911 SERVICE: FieldSmith is designed strictly for commercial and residential contractor service dispatches (e.g., burst pipes, major active water leaks, collapsed subfloors, fallen tree hazards, electrical sparking). FieldSmith is NOT a substitute for 911, public safety answering points (PSAPs), or official emergency services. If a caller is in immediate danger of bodily harm, they must dial 911 immediately.
GPS pin drops collected via emergency SMS intake links depend on mobile device GPS sensors, cellular network towers, and caller browser permissions. Positional accuracy is advisory and subject to device telemetry constraints.
⚖️ 5. TCPA & Florida FTSA Solicitor Trap Engine
FieldSmith includes an automated solicitor defense engine that records caller ID information, caller statements, and cross-references them with corporate registry data (such as the Florida Division of Corporations):
- The solicitor vault provides factual evidentiary records (timestamps, call duration, transcripts, Sunbiz registration data) for your convenience.
- No Legal Advice: FieldSmith is a software platform, not a law firm. Evidentiary records do not constitute formal legal counsel. Any decision to pursue statutory damages under the Telephone Consumer Protection Act (47 U.S.C. ? 227) or Florida Telemarketing Act (F.S. ? 501.059) should be evaluated independently or with licensed legal representation.
💳 6. Subscriptions, Free Trials, & Cancellations
- Tiers & Limits: Subscriptions are offered in monthly and annual plans (Individual: 125 calls/mo; Business: 450 calls/mo; Fleet: 1,200 calls/mo). Additional call volume packs may be added within the app.
- Free Trials: Where eligible, free trials provide complete access to the selected tier for 7 days. Unless cancelled prior to trial expiration via Google Play Store subscriptions, the subscription automatically renews at the chosen period.
- Cancellations & Refunds: You may cancel anytime via Google Play Store > Subscriptions. Cancellation halts future renewals while maintaining access through the end of the current billing cycle. All billing and refund requests are governed by Google Play Store policies.
🛡️ 7. Limitation of Liability & Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDSMITH AND CALLSMITH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, TELECOMMUNICATION CARRIER OUTAGES, OR MISSED CONTRACTS ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
You agree to indemnify and hold harmless FieldSmith from any third-party claims arising from your failure to notify callers where required by local recording laws or your provision of trade contracting services.
🏛️ 8. Governing Law & Dispute Resolution
These Terms are governed by and construed under the laws of the State of Florida, without regard to its conflict of law principles. Any legal dispute or proceeding arising out of or related to FieldSmith shall be brought exclusively in the state or federal courts located in Polk County, Florida.
